1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the EcoWorm Solutions website (the "Website") and the purchase of any products, training, or digital content offered by EcoWorm Solutions ("EcoWorm", "we", "us", or "our"). By accessing the Website or placing an order, you ("you" or the "Customer") agree to be bound by these Terms. If you do not agree, please do not use the Website.
2. About us
EcoWorm Solutions is a South African business supplying live composting worms, premium vermicompost, worm composting training, and related digital products. Contact details, including our registered address and email, are available on the Contact section of the Website.
3. Eligibility & accounts
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. You are responsible for ensuring that any information you provide (including delivery address, contact details, and payment information) is accurate and complete.
4. Products and pricing
- All prices are quoted in South African Rand (ZAR) and, where applicable, include VAT.
- Product descriptions, photographs, and weights are indicative. Live worm counts and vermicompost volumes are estimated in good faith; minor natural variation may occur.
- We reserve the right to change prices, withdraw products, or correct pricing errors at any time before an order is accepted.
- Stock availability is not guaranteed. If we cannot fulfil an order, we will refund you in full.
5. Orders & acceptance
Submitting an order constitutes an offer to purchase. A binding contract is formed only once we confirm acceptance of your order in writing (by email or WhatsApp) and payment has been received. We may decline any order at our discretion.
6. Payment
Payment is processed securely through our designated payment provider. We do not store full card details on our servers. By submitting payment information you warrant that you are authorised to use the chosen payment method. Orders will not be dispatched until payment has cleared.
7. Delivery of live worms & vermicompost
- We deliver across South Africa via approved couriers. Delivery times are estimates and not guaranteed.
- Live worms are dispatched in breathable packaging designed for transit. The Customer is responsible for providing accurate delivery details and for being available to receive the parcel on the first delivery attempt.
- Risk in goods passes to the Customer on delivery. Live worms must be unpacked and housed within 24 hours of receipt; failure to do so may affect survival and voids any live-arrival guarantee.
- If your parcel arrives visibly damaged or the worms are not in good condition, contact us within 24 hours of delivery with photographs so we can assist.
8. Returns, refunds & the CPA
Your statutory rights under the Consumer Protection Act 68 of 2008 ("CPA") are not affected by these Terms.
- Live worms and vermicompost are perishable, living goods and are generally not returnable once delivered, except where they arrive defective, damaged, or not matching their description.
- Claims for defective or damaged goods must be made within 7 days of delivery, with supporting photographs.
- Approved refunds will be processed to the original payment method within 14 business days.
- Return shipping costs for non-defective items (where return is agreed at our discretion) are for the Customer's account.
9. Training services
- Training bookings are confirmed once payment (or the agreed deposit) is received.
- Cancellations more than 14 days before the training date receive a full refund less any administration fees. Cancellations within 14 days are non-refundable but may, at our discretion, be rescheduled once.
- We reserve the right to reschedule or cancel training due to insufficient enrolment, weather, or circumstances beyond our control. In such cases, you will be offered a transfer or a full refund.
- Training materials and content are provided for personal educational use and may not be redistributed or resold.
10. Digital products & ebooks
Digital products (including ebooks and downloadable guides) are licensed, not sold, for personal, non-commercial use. Due to their nature, digital products are non-refundable once download access has been granted, except where the file is defective or materially different from its description.
11. Intellectual property
All content on the Website — including text, images, logos, branding, training material, and ebooks — is the property of EcoWorm Solutions or its licensors and is protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.
12. Acceptable use
You agree not to:
- Use the Website for any unlawful, fraudulent, or harmful purpose;
- Attempt to gain unauthorised access to any part of the Website or its systems;
- Interfere with the operation of the Website or any other user's enjoyment of it;
- Resell EcoWorm products without prior written authorisation.
13. Disclaimers & limitation of liability
The Website and its content are provided "as is" without warranties of any kind, except as required by law. Information on composting, soil health, and worm farming is provided for general educational purposes and does not constitute professional advice for your specific situation.
To the maximum extent permitted by law, EcoWorm Solutions' total liability arising from or in connection with any order is limited to the amount actually paid by you for the goods or services that gave rise to the claim. We are not liable for indirect, incidental, or consequential losses, including loss of profit, crop loss, or business interruption.
14. Indemnity
You agree to indemnify and hold EcoWorm Solutions, its owners, employees, and agents harmless from any claim, loss, or expense arising from your breach of these Terms or your misuse of any product, training, or content supplied by us.
15. Privacy & data protection
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy. By using the Website you consent to such processing.
16. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on the Website, with the "Last updated" date shown above. Continued use of the Website or placing a new order after changes are posted constitutes acceptance of the revised Terms.
17. Governing law & disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Website will be subject to the non-exclusive jurisdiction of the South African courts. Nothing in these Terms limits your right to refer a complaint to the National Consumer Commission or any other competent regulator.
